Re DA 188/2021 for a Food & Drink Kiosk at 113 Macpherson Street, Bronte

I make the following comments in regard to the development application (DA) which should be refused:

Non complying development

The maximum allowed floor space ratio (FSR) limit for the site is 1:1. The existing building on the site has an FSR of 1:1 (Waverley Council calculation). Thus the proposal to build a kiosk on the site is a non-compliant development.

The FSR standard for the site has been confirmed as appropriate for the site many times since 2012. It has been examined by Waverley Council, the WLPP, the NSW Department of Planning and the Land & Environment Court. All have agreed that an FSR of 1:1 for the site is appropriate and have required all DAs since 2012 to comply with that standard.

The proposed food and drink kiosk, and the Clause 4.6 variation request, is unfounded for the following reasons:

  1.  The development will increase the visual bulk of the building at the Macpherson St level. It will have a negative impact on the streetscape at the point where the building is closest to the public domain.
  2. The kiosk will reduce the setback of the building at ground level to 0 m. i.e. it will have a solid wall along this part of its boundary.
  3. The proposal will break up the colonnade at the street front which detracts from the visual coherence of the existing building and the Macpherson St streetscape.
  4. For the above reasons, the kiosk is not in keeping with the design of the building and will look like an afterthought tacked onto the front of the building at street level. It does not “demonstrate architectural compatibility with the existing building” as required by Waverley Development Control Plan.
  5. The colonnade provides a transition space and an interface with the footpath and public domain. This design integrity will be lost with the proposed kiosk which will detract from the design excellence of the building.
  6. Approval will set a precedent for the rest of the colonnade to be enclosed and used for retail tenancy. This could see an extra 100 m2 added to the retail space, significantly increasing the footprint of the building, further breaching the FSR standard. It would further compound the negative impact on the architectural character of the existing building, on the streetscape, and on local residents.
  7. The proposed outdoor tables and chairs will cover a Telstra pit and reduce the space for pedestrians to walk past the building.

For the reasons listed above, the proposed non-complying development is not in the public interest and should be refused.
